4. Quotations and Pricing
Quotations provided by Alliance Metal Solutions, whether via the Site, email or any other communication channel, are estimates based on the information available at the time of quoting. Unless stated otherwise in writing, all quotations are:
- Valid for a period of 30 days from the date of issue, after which they may be revised to reflect changes in material costs, supplier pricing or scope.
- Exclusive of Goods and Services Tax (GST), which will be added at the applicable rate on invoicing, unless the quote explicitly states that prices are GST-inclusive.
- Based on the specifications, drawings, quantities and materials described in the enquiry. Any variation to these details may result in an adjusted price.
A quotation does not constitute an offer capable of acceptance. A binding agreement is formed only when we issue a written order confirmation or commence work on your project following receipt of your purchase order or written approval.
We reserve the right to adjust pricing in the event of significant fluctuations in raw-material costs (including steel, aluminium and stainless-steel pricing), changes to applicable tariffs or duties, or material alterations to the project scope requested by the customer after the quotation has been accepted.
5. Orders and Custom Fabrication
The majority of goods produced by Alliance Metal Solutions are custom-fabricated to the customer's specific requirements. Once an order has been confirmed and production has commenced, it may not be possible to cancel or modify the order without incurring costs. Cancellation and modification terms will be outlined in the relevant order confirmation or quotation documentation.
Customers are responsible for verifying the accuracy of all specifications, dimensions and material selections provided to us prior to order confirmation. Alliance Metal Solutions is not liable for errors or deficiencies resulting from incorrect or incomplete information supplied by the customer.
6. Delivery
Delivery timeframes communicated by Alliance Metal Solutions are estimates and not guaranteed. While we make every reasonable effort to meet estimated delivery dates, delays may occur due to factors outside our control, including material supply disruptions, equipment maintenance, adverse weather or transport issues. We will endeavour to notify you promptly of any material delay.
Risk in the goods passes to the customer upon delivery to the nominated delivery address or upon collection from our premises, whichever occurs first.
7. Payment Terms
Unless otherwise agreed in writing, payment terms are as follows:
- A deposit may be required prior to the commencement of fabrication, the amount of which will be specified in the quotation or order confirmation.
- The balance of the invoice is due within 30 days of the date of invoice, unless alternative arrangements have been agreed.
- Late payments may attract interest at the rate of 2% per month on the outstanding balance, calculated from the due date until the date of payment in full.
Title in the goods does not pass to the customer until payment has been received in full.
8. Limitation of Liability
To the maximum extent permitted by law, Alliance Metal Solutions excludes all liability for any indirect, incidental, special, consequential or punitive damages arising out of or in connection with your use of the Site or the supply of goods and services, regardless of whether such liability arises in contract, tort (including negligence), statute or otherwise.
Nothing in these Terms is intended to exclude, restrict or modify any consumer guarantee or right you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable law that cannot be lawfully excluded or limited. Where our liability cannot be excluded, it is limited, at our discretion, to the resupply of the goods or services or the cost of having the goods or services resupplied.
